Bruce Lehrmann's barrister Steven Whybrow SC has suggested that Brittany Higgins lied to her boss about being raped because she was worried she would lose her job.
Bruce Lehrmann's barrister Steven Whybrow SC said it's clear from the CCTV at The Dock hotel that Bruce Lehrmann did not ply Brittany Higgins with drinks.
"Had Lehrmann responded to Ten's attempts to contact him, Ten would have included Lehrmann's side of the story, by including his response or the substance of his response, in the matters complained of," the defence says.
In his letter, Mr Drumgold then said the conduct of 'investigators has been equally concerning' and accused them of 'regularly conferencing' with Mr Lehrmann's legal team during breaks - which Mr Whybrow denied when questioned during the inquiry.
Justice Michael Lee also told the court that parts of both Ms Higgins and Mr Lehrmann's evidence in the trial can't be relied upon.
Mr Lehrmann's lawyers filed two statements of claim in the Federal Court on Tuesday.
