Authorities have not yet explained what Hemphill's involvement in the incident was, but Hemphill's attorney, Lee Gerald, told BuzzFeed News that Hemphill was the third officer at the scene when they first stopped Nichols.
Hemphill twice says to an officer who was with him: “I hope they stomp his ass.”
Hemphill was the third officer at the traffic stop that preceded the arrest but was not at the location where Nichols was beaten after he ran away.

Mr Hemphill never resurfaced from the Phantom Springs Cave in West Texas.
"Officer Preston Hemphill and other officer's actions and inactions have been and continue to be the subject of this investigation," Memphis police said in a news release Monday.
On February 22, a district court judge ordered that Hemphill would be held without bond at the Charles County Detention Center.
Rudolph said information on disciplinary action taken against Hemphill was not immediately released because Hemphill was not fired and the department typically releases information about officers who are relieved of duty after an investigation ends.
