David Sigale, a Wheaton-based attorney who has filed a number lawsuits on behalf of clients who believe their Second Amendment rights were violated, agreed that the new law won’t hold up if the Bruen case decision is applied.
Now, thanks to the decision handed down in the New York State Rifle & Pistol Association v. Bruen case, having to invoke history to decide gun violence cases has raised to another level the difficulty in getting meaningful gun legislation passed.
The Bruen decision rejected a standard that allowed some restrictions to the Second Amendment if they are balanced by a state’s interest in protecting public health and safety.
